GBS International FRAUD SCAM

Explanation of Claim:

From 04/11/2009 to 04/18/2009 I/we visited Cabo San Lucas, Mexico.

Arrival 4/11/09: During our visit as soon as we arrived at Los Cabo airport and received our luggage, walk through/passed the area where the timeshare booths, to the third area to buy our ticket for shuttle to our resort. Purchased shuttle tickets and they were grabbed out of my husband’s hands and we were told to follow the gentleman to the shuttle. We were very confused and unsuspecting of any conlusion to a time-share resort. The gentleman stopped at the desk just before the exit door to the outside area and said we need to see a presentation at Hacienda Encantada and for our inconvinence they will pay us $350 USD cash. He pleaded that he needs to make money to feed his family and this is all can do. He guaranteed that it would be 30 minutes of looking at a new development and they give you breakfast during the presentation. My husband said no, and we were hard press he needed money to feed his family and just visit the resort for a 30 minutes presentation and then leave. Then, he stated we have to go because he has our shuttle tickets that we paid for by our own money. Since we are in a foreign country and confused, we complied which required us to give him $40.00 USD deposit to guarantee we will show up at the resort. So we did, and he finally had release a shuttle (that we paid ourselves) to deliver us to our hotel.

April 12, 2009 (Sunday morning) my husband and I took a taxi from our hotel to Hacienda Encantada Resort in Los Cabo, MX. We were greeted and they rounded us up like cattle in a stock pen. Advised that we must stay for lease 90 minutes and then can go home. The salesman, Rick was specially selected for us (because were over the age of 54+) he began his speech with all sorts of information such as this is a great place only few places are available to rent or share rent because Cabo San Lucas has hit their number of timeshare condos to build. This is the last in the area and a big investment. I did not believe his lies and even told him. He became very upset with me and said we could not leave for another 90 minutes at a minimum and remained sitting at the table across from him. He stated they have many condos themselves and they rent them out every year for $1,000 per night. Told us were special and his friend only received this information. Then he started to high pressure that we would be loser if we didn’t buy the timeshare for investments. They are being rented out for over $1,000.00/per night for the two-bedroom condo. He went over, over. Over and over how a great investment and would be losers if we didn’t buy. He would not lets us leave and had us kept capture to his full attention for over two hours or more. Rick constant re stating over and over, he continued He kept high pressuring me, until I couldn’t take it anymore and stood up and stated I’m too stressed out. Physically my glands in my neck were starting to swell and I was had become over whelmed with anxiety.

Then the sales rep, Rick used high pressure tactics, will not let us leave to invoke a high level of stress and then gave me free drinks (with alcohol, he never mention that the drinks have alcohol) to take the "edge off". I became very intoxicated that I had impaired my judgment. For in the beginning of the presentation I didn't agree to his information and told him he was lying and rude. Because of my intoxication my judgment was lost and impaired. I even had a very hard time to seem like I’m okay but was very intoxicated. My judgment was so impaired and over whelm with stress I had not any restraints and fell under Rick spell for great investment. He advised I could take out money and future money out of my 401K-pension plan to pay for this great investment that will supply my husband and I with income instead of relying on our 401K pension plans. This is our hard earned money that years we had placed small amount for our senior years that is only nine years away. We don’t have much, not enough to pay off the contracts contracts but enough to pay the down payment. The rest was from our future money to be put away. This is terrible to scam an older person out of their little monies of savings. I don’t know how he got the upper hand of me of being afraid of him and his cunning sales tactics. With all the stress, anxiety and alcoholic combination was a dreadful combination for me and never wanted to be in that situation again.

We were constantly told that we were losers if we didn't purchase the timeshares for investments. Stated we could rent our timeshare for at lease 6 times the maintenance fee for each timeshare (not true per ITT Resorts). We were given the leasing company that handles all of his investments. That leasing vacation company was told to contact me. I did receive a call from Janet Drummet with ITT Resorts 888-823-0340 on April 21, 2009. She advised they have an inventory and the standard mark up for vacation rentals is 2 times it maintenance fee. However we would have to pay $399 initial fee to sign up with their company. Again false information

Our Age for us is over 54+ and with our medications and my husband’s two major strokes in 2007 is not mentally stable for any kind of decisions and cannot handle any confrontation at all. The sales kept hammering away, pressuring and came back with two alcoholic drinks to get me over the edge. I am on two types of medication one for anxiety -buspar and citalopram that both medication states impairment of thinking with alcohol. My judgment and thinking became impaired, over whelm, then intoxicated and he was pressuring me to buy for investments and I said why not two at $30,940 USD/Each and deposit of …definitely intoxicated for I knew before I had impaired thinking I disagreed to his information! When it was time to sign the contract and they took my credit card I really didn’t understand what they said when signing both contracts 5201 & 5202. Then the Sales Rep, Rick took my husband and me for additional drinks in car to the new marina being build on the east side of Cabo End Lands.

04/15/09 I took out the contract and started to read it and there were questionable or non-written information that I did remember Rick promised. We went back to resort in person and requested to Anida with the Contract/Sales dept. We were placed in a small room that we presented her with both contract to cancel. She stated, she could not cancel it and called our sales rep, Rick to the room. Once he arrives, he had an hypnotic trance on me that I froze and became over-whelm and afraid and had no control for this stress fear is very confusing and freighting, being overstressed again, we walked away, Remind you, my medication was all off from the prior day and my acidity was off the wall. My stress and anxiety affected my physical by my glands in my neck were swollen and constant sweating.

4/18/09 All morning &day at airport to flights back to Houston, Texas arrived home 6:00 pm and picked up our animals that were boarded. I start to calm down and realized I need to purse cancellation of both contracts from the US.
On their entire document given to us, Hacienda Encantada doesn’t supply anywhere a phone number to their sales/contract dept to contact them.

4/19/09 Again, getting stressed, I contacted my credit card company to dispute the charge $6,980.00 per contract = $13,960.00 total.

4/20/09 Monday, arrived at work were I was to contact GBS International that was supplied in our documents as their customer service dept. Contacted by phone and faxed all disputed information to them.
4/29/08 GBS International Company contacted me to state Hacienda Encantada advised them they will not accept my dispute and must pay full contract or cancel with 50% of Contract paid off. I explain this wasn’t acceptable for they are not representing me as I was assured by GBS International customer service personal.
I had spent many stressful hours on the phone, emails and forwarding documents that there isn't any response since the signing of the contract.

Please, I need your assistance to have the 2 contracts 5201 & 5202 At Hacienda Encantada cancelled and refund deposit $13,960.

4/12/09 - signed contracts with Hacienda Encantada Resort “HE Resort” under duress and intoxication for impair judgment. Very Stress from Coerce ness by sales Rick


4/15/09 - Went personally to HE Resort and notified Ameda we want to cancel both contracts. She said we can’t cancel and called Rick to talk us and again very stressed and left premises.
It literally took me all week to calm my anxiety and stress level down and ready to return home. The ordeal was very over whelming and unforgettable for two middle age couple to go through such an experience.
4/18/09 - Airport all day, arrived in Houston, TX late evening

4/19/09 - Being back home, I am now capable to take actions to null contracts.
Contacted Credit Card Company: Chase to dispute both deposit charges of $6980.00 each that equal a sum of $13,960.00


4/20/09 – Looking back just make my blood curdle and stress that I now need to work on getting this fiasco taken care of.
At work on Monday and have access to computer.
Search through all documents received by HE Resort and only way to contact them was through their Customer Service with GBS International in Florida.
Contacted GBS and dispute contracts to be null and void with full deposit return.

I stayed in contact with Gabriel and George representative of GBS 877-436-7232. Forward faxes and documents to null contracts with full return deposits. Various phone calls took place and was advised pending cancellation. Then on April 28th - 30th George stated the Developer turned down the dispute and will not cancel contracts. Even though on their records they still have the contracts status as Pending Cancellation.

5/04/09 Located HE Resort Sales/Reservation number on the intranet and called 877-243-243-4840 transfers to sales office at 7077.
I asked for the Sales manager and Bridget came to the phone and we spoke. I explain the situation and need to null contracts with full deposit. She stated she will advise her board of how wrongly we were treated and that is not how they should operate. She said to send all our letter and documents to at Bridget Giem@gmail.com . She will have this taken care of for me.

5/08/09 many follow up by email and phone calls I was forwarded by phone to the Sales Director, Cody Underdahl. Who stated he was the Sales Director and was updated with my problem and is presented to the Developer Board Meeting that was scheduled May 29th - June 1st.

I received an email from Cody stating that my case is under process and we should be hearing back from the developer on June 3, 2009. Again, many follow up calls and I am still getting the run-around. Last call to Cody was 6/11/09 and advised their still waiting.
I am beside myself with the horrific problem and how I am being continuously being scammed and taken advantage and very, very tired of the Hacienda Encantada’s sales and unprofessional, illegal tactics.

We are submitting a claim against Hacienda Encantada Resort & Spa for the amount of both contracts 5201 and 5202 total full amount $61,880.00 to be null and refund full deposit $13,960.00 USD. This amount includes $61,880.00USD for our basic contract value. We wish a full refund of these amounts for the following reasons: Null contract due to signed under duress, high pressure sales gimmicks and deadly mixture of alcohol drinks to become mental impaired for judgment.


In conclusion, we feel that a full refund is justified since:

1. We cancelled verbally at the sales office the contact in accordance with Mexican law [within 5 days of signing the contract, within 5 days of receiving the product, or before we ever received the product.]
2. Unlawful sales scams and high-pressure sales schemes to impaired one judgment to comprehend what is being signed.
3. Miss representation of sales staff claiming to be of management.

And finally GBS lies to US.
